What is Mediation and Arbitration?

There are various approaches to mediation and arbitration. 

Mediation is a process where the parties participate in discussing the challenge between them or issues they want resolved without having to pay thousands of dollars and wait years to have a civil case concluded in the court system.  That ties up resources and time where the person could be making money and expanding their business or skill; depending what the conflict is.  The Mediator does not come up with the solutions, the Mediator is there to listen closely to what is going on with each party and work to address underlying emotional roadblocks or help the parties reach a financial settlement based on simply the market place and resources which have been expended.  Often it is allowing the parties to simply get past their roadblocks of personality or past relationship and reach a conclusion that benefits them in the end.

 

Some people refer to mediation as “conflict resolution”.  However you want to approach it, it is the process where the mediator helps the parties clarify their issues and what it will take to satisfy them or make them whole.  If you think your problems are so entrenched that “no one” could help you reach a resolution with that other party…….think again.  There was a bank case which could not be settled for three years and just prior to going to trial, the Judge ordered “one more” attempt to resolve the issues and that case landed in Ann’s lap.  It was resolved in an afternoon and both parties felt they had “won”; because both parties do “win” when you reach a satisfactory resolution.

 

Arbitration, is a little different.  Again, you have both parties come together with the Arbitrator and discuss their issues and potential resolutions.  In this situation though, after hearing all of the information, the Arbitrator comes up with the resolution.
